Abstract
This study aims to investigate the potential impact that litigation may have on the issues of case history recording, management and prognosis of patients undergoing compensation claims. The objective for undertaking this study was to highlight any patterns within these issues that could be developed into guidelines for undergraduate and newly qualified osteopaths whose exposure to the medico-legal system is limited.The method involved sending 100 questionnaires to registered osteopaths; there were no other inclusion or exclusion criteria. The questionnaire aimed to elicit details about the osteopaths and their practices with particular reference to the case history recording, management and prognosis of patients undergoing litigation. The results reflected that litigation did not adversely affect patient management and prognosis and that most of the patients seen had sustained whiplash injuries from road traffic accidents. However, the issues of recording the history in more detail particularly the onset, aetiology and previous injury and taking care when explaining prognosis were raised.The medico-legal aspect of osteopathic patient management is still relatively uncovered ground. However, in light of our society moving into an increasingly litigious state it may be advisable for the profession to broaden its involvement in the medico-legal system. Establishing the profession as a valuable source of expertise can only enhance its overall credence, in addition to the individuals that provide the service, both in the eyes of the public and the other professions involved in the cases.
